The problem is that consumers feel helpless against attorneys whom they suspect of overbilling. Getting a fixed price has traditionally been the only solution but is not always practical. Another is to authenticate billable time using a billing assurance product like SureTime (www.suretime.com). We use it with all off-site professionals who bill us by the hour.

Hi Eric,

This is precicely one of the reasons why Exemplar Law Partners was founded (abandoning the billable hour in favor of a fixed-price model). I have interviewed hundreds of attorneys, partners and associates alike, many of which tell me that billing fraud and bill padding is a part of daily business at their firms. It is an outrageous practice and it is time for the leaders of this industry to stand up and demand change. I applaud Mr. Farmer for his courage and am proud to be a part of the solution by offering clients a model that makes more sense and is not prone to fraud. The foundation of this noble profession is TRUST. Without the trust of our clients, we cannot be effective advocates. This foundation has ruptured at the billable hour firms across this naiton. Hopefully, we will inspire more leaders to bring about positive change in the industry.
